''Us Shaqs Ka Roza Nahi Hoga Jo Fajr Se Pehle Hi Roza Rakne Ki Niyyat Na Kare''

''Huwa Ittefaqul Mujtahideena Fil Asri Minal Usoor Alal Hukmish Shar'ee Ala Baada Wafaatin Nabi Sallallahu Alaihi Wa Sallam Bid Dalil.''

''Ijma Se Muraad Nabi Sallallahu Alaihi Wa Sallam Ki Wafaat Ke Baad Kis Khaas Daur Mein (Ummat E Islamiya Ke) Tamam Mujtahid Ka Kisi Daleel Ke Saath Kisi

¤¤Ijma Ki Sharait¤¤

1. Matlooba Mas'ale Par Muttafiq Hone Wale Afraad Mujtahid Hon Warna Ijma Mo'tabar Na Hoga.

2. Mujtahideen Ke Ittefaaq Se Muraad Tamam Mujtahideen Ka Ittefaaq Hai Aisa Nahi Hona Chahiye Ke Sirf Ek Shahr Wale Ya Ek Basti Ke Ulama Hi Kisi Mas'ale Par Jama Hon Kyunke Ek Ki Muqalifat Bhi Ijma Ke Munaqid Hone Mein Rukawat Hai.

3. Tamam Mujtahideen Musalmaan Hon.

4. Jab Kisi Mas'ale Par Tamam Mujtahid Muttafiq Hojaen To Phir Zaruri Hai Ke Ittefaqi Faisla Amal Mein Aajaye. Alawaazein Ya Shart Nahi Hai Ke Tamam Mujtahideen Ki Maut Bhi Is Ittefaaq Par Hi Ho.

5. Ijmaa Ke Liye Zaruri Hai Ke Kisi Shar'i Hukm Par Ittefaaq Ho Nake Tib, Riyadhi Ya Lughat Se Mutalliq Kisi Mas'ale Par Ho.

6. Sirf Wahi Ijma Qabil E Qabool Hoga Jo Nabi Kareem Sallallahu Alaihi Wa Sallam Ki Wafaat Ke Baad Hua Ho.

7. Ijmaa Ke Liye Kisi Shar'i Dalil Ka Hona Bhi Zaruri Hai Jis Par Sab Muttafiq Hue Hon, Mahaz Apni Khwahish Par Kiya Jane Wala Ijma Mo'tabar Nahi Hoga.

¤¤Ijma Ki Misalen¤¤

1. Musalmaan Aurat Ka Kisi Ghair Muslim Mard Se Nikaah Nahi Ho Sakta.

2. Phoopi Aur Bhatiji, Khala Aur Bhanji Ko Ba'ek Waqt Nikah Mein Nahi Rakha Ja Sakta.

3. Maftooha Raazi Ko Faatiheen Ke Darmiyan Deegar Amwaal E Ghanimat Ki Tarah Nahi Baanta Jayega.

4. Agar Sage Bhai Behen Na Hon Toh Baap Ki Taraf Se Banne Wale Bhai Behen Ko Un Ka Hissa Diya Jayega.

1. ''Aur Hum Ne Aap Ki Taraf Zikr Nazil Kiya Taake Aap Logon Ke Liye Un Ahkamaat Ko Wazeh Karden Jo Un Ki Taraf (Quran Ki Soorat Mein) Nazil Kiye Gaye.'' [An-Nahl:44]

2. ''Woh Apni Khushi Nafs Se Nahi Bolta, Wo To Ek Wahi Hai Jo (Is Ki Taraf) Nazil Ki Jaati Hai.''

7. ''Kisi Momin Mard Aur Kisi Momin Aurat Ko Ye Laiq Nahi Ke Jab Allah Ta'la Aur Uske Rasool Kisi Kaam Ka Hukm Den Toh Phir Unhi Apne Kaam Ka Koi Ikhtiyar Baqi Rah Jaye'' [Al-Ahzab:36]

8. Sahaba, Taba'een, Taba Taba'een Aur Aa'imma E Izam Sab Ka Is Baat Par Ittefaq Hai Ke Sunnat E Nabawi Se Shar'ee Ahkaam Saabit Hote Hain Aur Aaj Tak Sab Musalman Isi Eemaan O Aqaid Par Qaim Hain.

9. Agar Sunnat E Nabawi Ko Shariyat Ka Ma'qiz Taslim Na Kiya Jaye Toh Quran E Majeed Ke Kitne Hi Aise Ahkamaat Hain Jin Par Amal Na Mumkin Hojayega. Maslan Quran Mein Namaz Ka Hukm Hai Lekin Is Ki Rakat, Is Ke Auqat, Is Ki Duaen, Azkar Aur Tareeqa Waghaira Sab Kuch Hadees Se Milega. Isi Tarah Roza, Hajj, Zakat Waghairah Ke Bhi Quran Mein Mahaz Mujmal Ahkam Hai Un Sab Ki Tafseel Ahadees Se Hi Milti Hai.

¤¤Sunnat Ki Hifazat¤¤

Jis Tarah Allah Ta'la Ne Quran E Majed Ki Hifazat Farmayi Hai, Isi Tarah Sunnat Ki Bhi Hifazat Ki Hai, Kyunke Guzishta Aayat Mein ''Zikr'' Ka Lafz Istemal Hua Hai Aur Is Mein Woh Tamam Ahkamaat Shamil Hai Jinhen Allah Ta'la Ne Nazil Farmaya Hai Aur Hadees Ke Ahkaam Bhi Fil Haqiqat Allah Ki Taraf Se Hi Hai Jaisa Ke Allah Ta'la Ne Farmaya, ''Ye Nabi Apne Khushi Se Nahi Bolta, Balke Woh To Wahi Hai Jo Us Par Nazil Ki Jaati Hai.'' Mazeed Hadees Ko Bhi Ek Doosri Aayat Mein Zikr Kaha Gaya Hai Aur Woh Ye Hai:

''Wa Anzalna Ilaykaz Zikra Litubayyina Linnaasi Maa Nuzzila Ilayhim''

''Aur Hum Ne Aap Ki Taraf Zikr Nazil Kiya Taake Aap Logon Ke Liye Woh Ahkamaat Wazeh Karden Jo Un Ki Taraf (Quran Ki Soorat Mein) Nazil Kiye Gaye Hai.''

¤¤Sunnat Ki Aqsaam¤¤

Sanad Ke Aetbaar Se Sunnat Ki Do Qismein Hai:

1. Mutawatir: Aisi Sunnat Jise Ibteda Se Inteha Tak Logon Ki Itni Badi Tedad Riwayat Kare Jin Ka Jhoot Par Jama Hojana Aql Se Mahaal Ho.

Baaz Auqaat Ye Tawatir Lafzi Hota Hai Yani Logon Ki Ek Bohut Badi Tedaad Hadees Ke Ek Hi Lafz Riwayat Karti Ho. Aur Kabhi Ye Tawatir Ma'anwi Hota Hai Woh Is Tarah Ke Logon Ki Ek Badi Jamaat Muqtalif Alfaz Se Riwayat Karti Ho Lekin Un Sab Ka Maani Ek Ho. Yaad Rahe Ke Ye Donon Tawatir Pukhta O Yaqeeni Ilm Ka Faida Dete Hain Aur Bil Ittefaaq Hujjat Hain.

2. Qabr E Wahid: Is Se Muraad Aisi Sunnat Hai Jise Bayan Karne Walon Ki Tadad Tawatir Ki Had Tak Na Pahunchti Ho Bil Alfaz Degar Is Mein Tawatir Ki Sharait Na Paayi Jaati Hon. Is Ki Teen Aqsam Hai:

1. Mash'hoor: Jise Har Daur Mein Kam Az Kam Teen Afraad Riwayat Karen Aur Woh Tawatir Ki Had Tak Na Pahunche.

2. Azeez: Jise Har Daur Mein Kam Az Kam Do Afraad Ne Riwayat Kiya Ho.

3. Ghareeb: Jise Ibteda Aur Inteha Ke Mabayn Kisi Daur Mein Sirf Ek Fard Riwayat Kare.

Ye Sunnat Is Waqt Qaabil Hujjat Hai Jab Is Ki Sanad Mutassal Ho, Is Ke Tamam Raawi Aadil O Dh'aabit Hon Aur Is Ki Sanad Ya Matn Mein Koi Illat Ya Shuzooz Na Ho.

Khabre Wahid Hujjat Hai Aur Iske Dalail Darh Zail Hain:

1. ''Agar Tumhen Ilm Na Hotoh Ahle Ilm Se Daryaft Karlo'' [An-Nahl:43]

Is Aayat Se Maloom Hua Ke Agar Kisi Mas'ale Ka Ilm Na Hotoh Kisi Ek Aalim Se Poochlena Kafi Hai Kyunke Yahan Allah Ta'la Ne Aisi Koi Shart Nahi Lagai Ke Ulma Ki Jamaat Se Poochna Zaruri Hai.

2. ''Aisa Kyun Na Kiya Jaye Ke Har Firqe Se Ek Taifa Nikle Aur Deen Ki Samaj Hasil Kare.''
[At-Tawba:221]

Imam Bukhari Rahimaullah Farmate Hain ''Taifa'' Ek Aadmi Ko Bhi Kehte Hain.

Maloom Hua Ke Agar Ek Aadmi Bhi Deen Ki Samaj Hasil Karke Apni Qaum Ko Ahkaame Shariyat Sikhaye Toh Durust Hai.

3. Hazrat Abdullah Bin Mas'ud Radhi Allahu Anhu Se Marvi Hai Ke Rasool Sallallahu Alaihi Wa Sallam Ne Farmaya:

''Kisi Shaqs Ko Hazrat Bilal Radhi Allahu Anhu Ki Azaan Sahri Khane Se Se Na Roke Kyunke Wo Sirf Is Liye Azaan Dete Hain Take Jo Namaz Ke Liye Bedaar Hain Woh Wapas Aajayen Aur Jo Soye Hye Hain Woh Bedaar Hojaen.''

Ma'loom Hua Ke Ek Aadmi Ki Azaan-E-Namaz, Sahri Aur Iftaari Ke Liye Mo'tabar Hai Lihaza Is Ki Rivayat Bhi Qabil E Amal Honi Chahiye Ba'soorat Degar Un Dino Ka Inkar Kiya Jayega.

4. Log Masjid E Quba Mein Baitul Muqaddas Ki Janib Ruq Karke Fajr Ki Namaz Ada Kar Rahe The. Dusri Rakat Mein, Ek Aadmi Ne Aakar Kaha, ''Aap Sallallahu Alaihi Wa Sallam Ko Namaz Mein Kaaba Ki Taraf Munh Karne Ka Hukm Diya Gaya Hai, Is Liye Tum Bhi Is Taraf Ruq Karlo.''

''Un Logon Ke Chehre Shaam Ki Taraf The, Phir Woh Log Kaaba Ki Taraf Ghoom Gaye.''

5. Imam Bukhari Rahimaullah Ne Apni Kitab Sahih Bukhari Mein Khabre Wahid Ki Hujjat Par Ek Kitab Qaim Ki Hai Aur Us Mein Ekkis (21) Ahadees Aur Chand Aayaat Se Istedlal Karte Hue Khabre Wahid Ki Hujjat Ko Saabit Kiya Hai, Mazeed Tafseel Ke Liye Inhein Dekha Ja Sakta Hai.

Pehle Ke Hisson Mein Alhamdulillah Hum Ne, Fiqh Ke Mani Wa Mafhoom, Fiqh Ki Ahmyat O Zarurat Aur Quran Ka Taruf Samjhe The, Ab Aage:

¤¤Qaasiyat E Quraan¤¤

1. Yeh Allah Ta'la Ka Aisa Kalam Hai Jo Muhammad Sallallahu Alaihi Wa Sallam Par Nazil Hua Yani Doosri Kitaben Maslan Taurat, Injeel Waghairah Muhammad Sallallahu Alaihi Wa Sallam Par Nahi Hue Isliye Woh Quran Nahi.

2. Quran Ke Alfaz Aur Maani Donon Allah Ta'la Ki Taraf Se Nazil Kardah Hain. Is Bina Par Ahadees Quran Mein Shamil Nahi Kyunke Agarche Un Ke Maani Wa Mafhoom Bhi Allah Ta'la Ki Janib Se Hi Hain, Lekin Unke Alfaz Allah Ta'la Ki Taraf Se Nahi.

3. Ye Mutawatir Hokar Hum Tak Pahunche Hai, Yaani Ise Hum Tak Pahunchane Wale Afraad Ki Tedad Is Qadr Zyadah Hai Ke Yeh Waham O Guman Ho Hi Nahi Sakta Ke Ye Sab Jhoot Par Jama Ho Sakte Hain.

4. Quran Majeed Har Qism Ki Kami Beshi Se Mahfooz Kitab Hai Kyunke Is Ki Hifazat Ki Zimma Khud Allah Ta'la Ne Liya Hai Jaisa Ke Irshad -E-Baari Ta'la Hai Ke, ''Bila Shubha Hum Ne Quran Nazil Kiya Hai Aur Yaqeenan Hum Hi Is Ke Muhafiz Hain.'' (Al-Hijr:9)

5. Quran Majeed Aajiz Kardene Wali Kitab Hai, Yani Saari Insaniyat Is Jaisa Kalam Pesh Karne Se Aajiz Hai Jaisa Ke Mandarje Zail Aayaat Se Ye Wazahat Hoti Hai:

''Aap Kehdijiye Ke Agar Tamam Insaan Aur Jinnat Is Jaisa Quran Laane Ke Liye Jama Ho Jayen Tab Bhi Iski Misl Nahi La Sakenge Khwah Wo Ek Doosre Ke Madadgaar Hi Kyun Na Ban Jayen.'' (Al-Isra:88)

''Kiya Yeh Kehtay Hain Kay Iss Quran Ko Issi Ney Gharha Hai Jawab Dijiye Kay Phir Tum Bhi Issi Ju Misil Das Surten Ghari Hui Ley Aao'' (Hood:13)

''Hum Ney Jo Kuch Apney Banday Per Utara Hai Uss Mein Agar Tumhen Shak Ho Aur Tum Sachay Ho To Iss Jaisi Aik Surat To Bana Lao......Pus Agar Tum Ney Na Kiya Aur Tum Hergiz Nahi Ker Sakoge'' (Surah Baqarah:24-25)

''Acha Agar Ye Sache Hain Toh Bhala Is Jaisa Ek Hi Baat Ye Bhi Toh Le Aayen'' (At-Toor:34)

¤¤Ae'jaaz Ke Muqhtalif Pehloo¤¤

1. Yaad Rahe Ke Quraan Ka Ae'jaaz Is Ki Is Fasahat Wa Balaghat Ki Wajah Se Hai Jisne Saare Arab Ko Hairaan Kardiya.

2. Is Ki Un Bayan Kardah Peshangoyiyon Ki Wajah Se Hai Ke Jo Baad Mein Bilfeal Isi Tarah Runuma Hoyen.

3. Isi Quraan Ne Aisi Qaumon Ke Bhi Haalaat Bayan Kar Diye Ke Jinhein Arab Ke Log Yaksar Bhool Chuke The Aur Un Ke Naam O Nishan Aur Aasaar Bhi Mit Chuke The.

4. Aur Aaj Ki Jadeed Science Sab O Roz Ki Mehnaton Se Kiye Hue Tajrubaat Wa Mashahidaat Ke Baad Jin Haqaiq Ka Inkishaf Kar Rahi Hai Quran-E-Majeed Sadiyon Pehle Un Mein Se Baaz Ki Taraf Ishara Kar Chuka Hai.

¤¤Mazaamin E Quran¤¤

1. Baaz To Aise Hain Ke Jin Ka Talluq Tawheed, Risalat Aur Aakhirat Se Hai.

2. Baaz Ka Talluq Akhlaqiyat Se Hai, Maslan Silah Rahmi, Sadq, Amanat Wa Diyanat, Jhoot Se Ijtenaab, Walidain Se Husn Sulook Aur Iffat O Ismat Waghairah.

3. Aur Baaz Ka Talluq Aise Aamaal Se Hai Jo Ya To Ibadat Se Mutalliq Hain Maslan Namaz, Roza, Hajj, I'tekaf Waghairah Ya Mua'milaat Se Maslan Jaraim, Hudood, Jihaad, Gharelu Muamilaat Waghairah.

¤¤Sab Se Pehli Aur Aakhri Nazil Hone Wali Aayaat¤¤

Muqtalif Aqwal Mein Se Sahih Tareen Qaul Ke Mutabiq Sab Se Pehle Ye Aayat Nazil Hui:

اقْرَأْ بِاسْمِ رَبِّكَ الَّذِي خَلَقَ''
(Surah Al Alaq:1)

Aur Hazrat Ibn Abbas Radhi Allahu Anhu Ke Qaul Ke Mutabiq Nabi Sallallahu Alaihi Wa Sallam Par Nazil Hone Wali Aakhri Aayat Ye Hai:

يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَذَرُوا مَا بَقِيَ مِنَ الرِّبَا إِن كُنتُم مُّؤْمِنِين....وَهُمْ لَا يُظْلَمُون
(Surah Baqarah: 279-281)

¤¤Hujjat E Quran¤¤

Tamam Musalmaan Is Par Muttafiq Hain Ke Qur'an Sab Ke Liye Hujjat Hai Aur Qanoonsari Ka Awwaleen Ma'qib Hai. Is Ki Hujat Ki Dalil Is Ka Rabbul Aalameen Ki Taraf Se Nazil Hona Hai Aur Is Baat Ka Saboot Ke Kya Ye Waqai Allah Ki Taraf Se Nazil Kardah Hai, Is Ka Woh A'jaz Hai, Ke Jise Peeche Bayan Kiya Ja Chuka Hai. Chunanche Jab Ye Baat Sabit Hai Ke Qur'an Allah Ta'la Ka Kalam Hai To Sab Par Lazim Hai Ke Ispar Amal Karen.

Lagvi Aetbaar Se Sunnat Har Aise Dastoor, Seerat Aur Tareeqe Ko Kehte Hain Jis Par Log Chalne Ke Aadi Hon Aur Us Ki Pabandi Karte Hon Jaisa Ke Is Aayat Mein Bhi Yahi Muraad Hai, ''Sunnatallahi Filladhina Qalao Min Qabl'' (Ahzab:62)
''Un Logon Mein Bhi Allah Ta'la Ka Yahi Dastoor Raha Hau Jo Un Se Pehle Guzar Chuke Hain.''

Taahum Istalaahi Wa Shar'ee Aetbaar Se Sunnat Ki Tareef Yun Ki Jaati Hai:

''Maa Adheifa Ilan Nabiyyi Min Qauli Au Fe'ali Au Taqreer''

Ba Alfaz Degar Ilm Mein Sirf Aise Ahkaam Shamil Hain Jo Ibadaat Aur Mu'milaat Se Mutalliq Hon Aur Aise Ahkaam Ka Is Mein Koi Dakhal Nahi Jo Aqaid Wa Eemaaniyaat Se Talluq Rakte Hon.

Fiqah Ki Ahmiyat Aur Zarurat

Ilm E Fiqah Hasil Karna Baz Auqaat To Farz Ayn Hojata Hai, Jaisa Ke Un Umoor O Masail Ka Seekhna Ke Jin Ke Baghair Koi Farz Ayn Hukm Adaa Hi Na Hosakta Ho Masalan Wuzu, Namaz Aur Roze Waghaira Ka Tareeqa O Kaifiyat. Aur Baz Ulma Ne Hazrat Anas Bin Malik Radhi Allahu Anhu Se Marwi Hadees:
''Talabul Ilmi Fareedhatun Ala Kulli Muslim.'' Sahih: Sahih Ibn Majah:183
''Ilm Ka Hasil Karna Har Musalmaan Par Farz Hai.''
Ko Isi Par Mahmool Kiya Hai (Yani Sirf Un Masail Ka Ilm Hasil Karna Har Musalman Par Farz Hai Jo Us Par Farz E Ayn Hain. Shafiya Ke Nazdeek Kisi Cheez Ke Waqt Se Pehle Hi Us Ka Seekhlena Lazim Hai Jaisa Ke Us Shaqs Par Juma Ke Liye Waqt Se Pehle Hi Saee O Koshish Karke Aana Lazim Hai Jiska Ghar Door Hai, Kyunke Ye Qaida Hai Ke Jo Cheez Jo Cheez Kisi Wajid Ki Takmeel Ke Liye Nagazeerah Ho, Woh Bhi Wajid Hai.

Phir Agar Koi Amal Fauri Taur Par Wajid Hoga To Uski Kaifiyat Seekhna Bhi Fauri Taur Par Wajid Hoga Aur Agar Koi Amal Taakheer Se Wajid Hoga Jaisa Ke Hajj Toh Us Ki Kaifiyat Seekhna Bhi Takheer Se Hi Wajid Hoga. Albatta Nikah, Khareed O Farokht Aur Tamam Muamilaat Ke Masail Ek Par Seekhna Wajid Nahi Hai Balke Jo Shaqs Un Mein Se Kuch Karna Chahta Hoga Sirf Usi Par Seekhna Wajid Hoga.
Aur Baz Auqaat Ilm E Fiqh Hasil Karna Nafil Bhi Hota Hai. Is Mein Woh Tamam Uloom Shamil Hai Jo Farz Kifayah Ki Miqhdaar Se Zaid Hai, Neez Awaamun Naas Ka Amal Ki Gharaz Se Nafli Ibadaat Seekhna Bhi Is Mein Shamil Hai.
